Terms of Use

1. About these Terms

These Terms of Use are a binding agreement between you and AzurApps FZ-LLC, Office 119, Dubai Internet City Building 1, Dubai, UAE ("we", "us"). They cover the Nano: AI Chatbot Assistant mobile apps for iOS and Android, their widgets, and the online services behind them (together, "Nano").

By installing or using Nano you accept these Terms. If you do not accept them, do not use Nano.

Our Privacy Policy explains how we handle personal data. It is a separate notice, not a contract term you agree to.

2. Who can use Nano

  • Adults. You may use Nano if you have reached the age of majority where you live (18 in most countries).
  • 16 and over, but not yet an adult. You may use Nano only if a parent or legal guardian has read and agreed to these Terms on your behalf. Purchases must be made by, or with the permission of, the parent or guardian.
  • Under 16. You may not use Nano.

Parents and guardians are responsible for the use of Nano by a minor in their care.

You may not use Nano if you are barred from doing so under the laws that apply to you, or if we have previously terminated your access for breaking these Terms.

3. Accounts

Guest accounts. Nano works without registration. When you first open the app, we create a guest account linked to an identifier for your device, so your chats have an owner.

Signing in. You can sign in with a supported provider (for example Google or Apple; the options depend on your platform and region). Signing in to a new profile keeps your guest history. Signing in to an existing profile moves your guest chats into that profile.

Your responsibilities. Keep your device and your sign-in provider account secure. You are responsible for activity under your account. Tell us promptly at info@azurapps.com if you believe someone else has access to it.

4. The service

Nano lets you talk to AI models and use AI tools: chat, assistants and companions, web and nearby search, translation, and generation or editing of images, video, speech and music.

Nano relies on AI models and technology supplied by other companies, which we reach through their official interfaces. Model names and logos shown in the app belong to their owners. We are not affiliated with, sponsored by, or endorsed by those companies.

The models and features on offer change over time and may differ by country, platform, app version and plan. We may add, change, limit or remove models and features.

5. Your content

Input and output. "Input" is what you submit: messages, photos, videos, audio, documents, links and location. "Output" is what Nano generates in response. Together they are "Your Content".

Ownership. As between you and us, you keep your rights in your Input, and we do not claim ownership of Output. You may use Output for any lawful purpose, including commercially, subject to these Terms and to any terms the underlying model provider places on its output.

Output may not be unique. AI models can return the same or similar results to different people. Output that other users receive is not yours.

Licence to us. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, convert, transmit and display Your Content, only as needed to operate, secure and support Nano for you. This includes sending it to the AI providers that produce your results. The licence ends when Your Content is deleted from our systems, except for backup copies that have not yet expired.

Your promises about Input. You confirm that you have the rights and permissions needed to submit your Input, including the consent of any person who appears in a photo, video or recording you upload, and that your Input and your use of Output do not break the law or anyone's rights.

6. AI output: read this before relying on it

  • Output can be wrong. It may be inaccurate, incomplete, out of date, biased or offensive. It does not represent our views. Check anything important against a reliable source.
  • Not professional advice. Nano does not provide medical, legal, financial, psychological or other professional advice. Do not use it in place of a qualified professional or in an emergency.
  • Companions are software. AI companions and characters are fictional and generated by a model. They are not real people, and nothing they say is a promise, a diagnosis, or a statement of fact about a real person.
  • Search results. Web and nearby search answers are built from third-party sources we do not control. Verify addresses, opening hours, prices and directions yourself.
  • Label what you share. When you share Output, do not present it as written or made by a human where that would mislead people.

7. Acceptable use

7.1 How you may not use Nano

You must not:

  • use Nano for anything unlawful, or to help someone else break the law;
  • interfere with Nano's security, integrity or performance, or try to get around usage limits, safety measures or access controls;
  • access Nano with bots, scrapers or other automated means, or resell, rent or provide Nano to third parties as your own service;
  • copy, modify, reverse engineer, decompile or create derivative works from the apps, except where the law gives you a right we cannot exclude;
  • use Nano or Output to build or train a competing AI model;
  • share your account with others or misrepresent who you are.

7.2 Content you may not submit or generate

You must not use Nano to create, upload or share content that:

  • promotes hatred or violence against people because of race, ethnicity, nationality, religion, sex, gender identity, sexual orientation, age, disability or a similar characteristic;
  • harasses, threatens, bullies or stalks anyone;
  • promotes or gives instructions for suicide, self-harm or eating disorders;
  • promotes terrorism or violent extremism, or glorifies real-world violence or suffering;
  • is fraudulent or deceptive, including scams, impersonation and disinformation;
  • is spam or unsolicited bulk messaging;
  • is malware or helps create ransomware, viruses or other harmful code;
  • is intended to manipulate elections or political processes;
  • is sexually explicit or pornographic, or offers sexual services. Sex education and health information are allowed.

7.3 Child safety

We have zero tolerance for content that sexualises, exploits or endangers minors. For these Terms a minor is anyone under 18, whatever local law says. This covers child sexual abuse material in any form, including AI-generated, fictional and role-play content, as well as grooming, sextortion, trafficking, and instructions for abusing or harming a child.

We may remove such content, terminate the account immediately, and report it to the relevant authorities. Our AI providers may also detect and report it on their own.

7.4 Other people's privacy and likeness

Do not upload or generate content that uses another person's face, body, voice, name or private information without their permission. In particular, you must not create sexual, intimate or degrading images or video of a real person, and you must not make content that passes itself off as a real person in order to deceive.

7.5 Intellectual property

Do not submit material that you have no right to use, and do not use Nano to infringe copyright, trade marks or other rights.

7.6 Provider policies

Your requests are processed by third-party AI models. You must also follow the usage policies of the provider whose model handles your request. A provider may refuse a request or block content under its own rules, and we may show you that the request was restricted.

7.7 Enforcement

If we reasonably believe you have broken this section, we may remove content, limit features, suspend or terminate your account, and report unlawful activity to the authorities. Section 13 explains what happens to paid plans in that case.

8. Reporting content and copyright complaints

To report Output or other content that you believe breaks these Terms, or to tell us that material in Nano infringes your copyright, write to policy@azurapps.com. Please include:

  • what the content is and where it appears;
  • why you believe it breaks these Terms or infringes your rights;
  • for copyright complaints: a description of the protected work, your contact details, a statement that you are the rights holder or authorised to act for them, and a statement that the information is accurate.

9. Plans, charges and payments

9.1 Free use

You can use a limited part of Nano for free. The free allowance (for example, how many messages you can send in a day and which models are included) is shown in the app and may change.

9.2 Charges

Paid features are metered in charges, Nano's in-app usage unit. Each action spends charges according to the model and the amount of work involved, so a long reply, an image or a video costs more than a short message. The app shows your balance.

If you stop a response part-way, the charges for the work already done are still spent.

Charges are a licence to use features of Nano. They are not money, have no cash value, and cannot be transferred, exchanged or redeemed outside Nano.

9.3 Subscription plans

Plans are auto-renewing subscriptions, billed monthly or yearly, and sold through the Apple App Store or Google Play. Each plan grants a set number of charges every month. On a yearly plan you receive the monthly amount each month, not the whole year's amount up front.

Plan charges you have not used by the next monthly grant expire and do not carry over.

The price, billing period and monthly charge amount are shown before you buy. Prices may differ by country and may include taxes.

9.4 Auto-renewal and cancellation

Your subscription renews automatically at the end of each billing period, and your store account is charged for the renewal within 24 hours before the period ends, unless you cancel at least 24 hours before it ends.

You can cancel at any time:

  • iOS: Settings → your name → Subscriptions, or your App Store account settings.
  • Android: Google Play → Payments & subscriptions → Subscriptions.

Deleting the app does not cancel a subscription. After you cancel, your plan stays active until the end of the period you have already paid for.

If a renewal payment fails, we may keep your plan active for a short grace period while the store retries the payment. If it still fails, the plan ends.

9.5 Top-ups

Top-ups are one-time purchases of extra charges and are offered only while you have an active plan. Top-up charges do not expire, but you can spend them only while a plan is active. If your plan ends, your top-up balance is kept and becomes usable again when you subscribe again.

9.6 Store accounts and restoring purchases

Purchases belong to the App Store or Google Play account that paid for them. You can restore them in the app after reinstalling or changing device. A plan bought with a store account applies to the Nano accounts used with that store account.

9.7 Refunds

Apple and Google take the payment and decide refunds under their own policies. Request a refund from Apple at reportaproblem.apple.com, or from Google Play through your order history. We cannot issue refunds for store purchases ourselves.

If a purchase is refunded or reversed, we remove the plan or the charges that came with it.

Nothing in this section limits refund or withdrawal rights that the law gives you and that cannot be waived.

9.8 Changes to prices and plans

We may change prices, plans and how many charges an action costs. A price change for an existing subscription takes effect no earlier than your next renewal, and you will be told in advance through the store or the app. If you do not agree, cancel before the change takes effect.

10. Our licence to you and our intellectual property

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Nano on devices you own or control, for your own use, under these Terms and the rules of the store you downloaded it from.

The apps, their design, code, text, graphics, the Nano name and logo, and all related rights belong to us or our licensors. Except for the licence above, these Terms give you no rights in them.

Nano connects to services run by others, such as sign-in providers, app stores, AI model providers and map data, and Output may contain links to third-party sites. Those services are governed by their own terms and privacy policies. We do not control them and are not responsible for them.

12. Availability and changes

Nano needs a compatible device and an internet connection. We work to keep it running, but we do not promise that it will always be available, uninterrupted, or free of errors. We may suspend Nano, or part of it, for maintenance, security or legal reasons.

13. Suspension and termination

You can stop using Nano at any time. You can delete your account and its data in the app, as described in the Privacy Policy. Deleting your account does not cancel a store subscription; cancel it separately as described in section 9.4.

We may suspend or end your access if you seriously or repeatedly break these Terms, if we are required to by law, or if your use creates risk or harm for us, other users or anyone else. Where it is reasonable to do so, we will tell you and give you a chance to respond.

If we end your access because you broke these Terms, you lose your remaining charges and are not entitled to a refund, except where the law requires one. If we discontinue Nano altogether, we will give reasonable notice and handle remaining paid time as the law requires.

Sections 5, 6 and 14 to 18 continue to apply after these Terms end.

14. Disclaimers

To the fullest extent the law allows, Nano and all Output are provided "as is" and "as available", without warranties of any kind, whether express or implied. This includes implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

We do not promise that Output will be correct, that Nano will meet your needs, or that any defect will be fixed.

15. Limitation of liability

To the fullest extent the law allows:

  • we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, arising from your use of Nano or reliance on Output;
  • our total liability for all claims relating to Nano is limited to the greater of the amount you paid us for Nano in the 12 months before the claim arose and USD 50.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for fraud, for death or personal injury caused by negligence, or under mandatory consumer protection rules in your country.

16. Indemnity

Where the law allows, you agree to cover our reasonable losses and costs arising from a third-party claim caused by your Input, your use of Output, or your breach of these Terms or of the law. This does not apply to the extent the claim results from our own breach or fault.

17. Sanctions and export

You confirm that you are not located in a country or territory under comprehensive trade sanctions that apply to us, and that you are not on a list of restricted or prohibited parties. You must not use Nano in breach of export control or sanctions laws.

18. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, without regard to its conflict-of-law rules. The courts of Dubai have jurisdiction over disputes. If you are a consumer, you keep the protection of the mandatory laws of the country where you live and may bring a claim in its courts.

Talk to us first. Before starting formal proceedings, the party with the complaint must send the other a written notice describing the dispute and the outcome it wants. We will send ours to the contact details we hold for you; send yours to policy@azurapps.com. Both sides will then try in good faith to settle the matter for 60 days.

No class actions. Where the law allows, disputes will be brought only on an individual basis and not as part of a class or representative action.

19. App store terms

Apple. If you downloaded Nano from the App Store:

  • these Terms are between you and us, not Apple, and Apple is not responsible for Nano or its content;
  • Apple has no obligation to provide maintenance or support for Nano;
  • if Nano fails to conform to a warranty that applies, you may notify Apple and Apple will refund the purchase price, if any; to the extent the law allows, Apple has no other warranty obligation;
  • we, not Apple, are responsible for handling claims relating to Nano, including product liability, legal compliance and consumer protection claims, and claims that Nano infringes a third party's intellectual property;
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you;
  • you must also follow the App Store's usage rules.

Google Play. If you downloaded Nano from Google Play, the Google Play Terms of Service also apply to your use of the store. Google is not a party to these Terms and is not responsible for Nano.

20. Changes to these Terms

We may update these Terms, for example when we add features, change plans, or when the law changes. If a change is material, we will tell you in the app or by other reasonable means before it takes effect. The date at the top shows the latest version. If you keep using Nano after a change takes effect, you accept the updated Terms. If you do not agree, stop using Nano and cancel any subscription.

21. General

  • If a court finds part of these Terms unenforceable, the rest stays in force.
  • If we do not enforce a term right away, we can still enforce it later.
  • You may not transfer your rights or duties under these Terms without our consent. We may transfer ours to an affiliate or to a successor in a merger, acquisition or sale of the business.
  • These Terms, with the documents they refer to, are the whole agreement between you and us about Nano.
  • These Terms are available in English and Russian. If the versions differ, the English version prevails, unless the law where you live says otherwise.
